Hi , I am just about to apply for a marriage based green card.
I have a minor criminal record unfortunately & was wondering if I need to also submit I-601 - waiver of inadmissability, ( $545 ! )
It is for aggrevated trespass, assault, shoplifting & caution for cannabis , nothing is since 2003 & the charges are minor. I am trying to determine if any constitute a crime of moral turpitude ?
Thanks for any help
Howie

Shoplifting is a CIMT but would usually qualify for an exception without needed for a waiver. The amount of marijuana is determinitive of waiver or not. Aggravated trespass, may or may not be a CIMT. Where did these thiungs happen? What charges were you CONVICTED of? How old were you? (Was it classified as a juvenile offense?) Was this all ONE incident? What was the disposition (punishment)?

All happened in UK between 92 - 2003, I was aged 23 - 34 ( and alot more foolish than now ! )
The aggevated trespass , assault & criminal damage were for involvement in eco - protesting.
The amount of cannabis was tiny , 4 g.
I've just got the police record & theres also 3 failing to surrenders, a caution for shoplifting & a criminal damage.
heres the list-
Criminal damage - conditional discharge 12 months, compensation 234 pounds, costs 25 pounds
common assault -----------------------12 months---------------40----------------40------
failing to surrender----------------------12 months
aggrevated trespass----------------------6 months --------40-----
failing to surrender No penalty x2
shoplifting caution
shoplifting fine 100 pounds, costs 20 pounds
possesssion cannabis caution.

Theres all the grim details ! Thanks for any advice !

Another question is do I need the court orders as well as the police record ? That would be a hassle as I have everything else ready to go

Your case might be difficult, because your convictions could raise issues moral turpitude. You might need the documentation, if you are ready, do you rather deal with an RFE which will delay your case or a complete case with all documentation? you need to make wise decision, because failure to produce documents will results s denial of your case. Expediency without proper preparation is a fool's pursuit.

Hmm, there is a time limit as i only have until feb 27 to get it in . I'll have to find out about court records quickly.
Thats my question about if i need a I-601 or just submit the rest now. I actually can't afford an attorney , the green card fees are already a stretch !
Thanks for any other advice
