CP Processing / H1-B ???

I am leaving in the US and working with H1-B. AF28xxx is a high number and I am thinking of applying through CP back home.

Question: If for any reason the application is refused: Is there a problem returning to the US with existing in status H1-B visa (already stamped on passport and valid til' 2008)?

Anybody ever heard of someone not being able re-enter the US after a CP denied back home???
