CP or AOS with the new law on 140/485 parallel processing

Could somebody comment on the new rule on 140/485 parallel processing and also if CP would sound lucarative as before???

EAD+AP = GC via CP

I think unless you want to have the real green card in your wallet instead of the same thing called EAD+AP,, whats the real benefit?
 
Hi all,
I need some answers.
My situation is I was working for Company A and company A applied for my GC.
I switched over to Company B.
Now at what stage of GC, i should go back to company A.
Since we can file for the 140 and 485 concurrently and EAD at what point i should join the company A.
Is it after 485 approval or what?

Argueably,you shouild be with the sponsoring company for 6 months... but INS might ask for an interview at the end of your process just to make sure you are working a. with the company or b. in a company with similiar job function... offcourse, Lady Luck is the God of Luck..
 
I was with the company, when the company started the process. I worked for the company for more than a year and switched over to new company.
now my question is, do i have to join that company before my case gets approved?
 
Just as Sunny has said " but INS might ask for an interview at the end of your process just to make sure you are working..." The big concern is the "MIGHT", but the probability is low and risk is yours to take. Ideally, the answer is YES to work with company A, at least for 6 months.
 
kanthan:you must be working for the company who is doing your green card. otherwise it it illegal since I-485 process assumes you are already working with that company.

I may not agree with you. Actually The green card is for future employment. Mine is done by company A, though i work under company B. I have applying for 485 now with the new law that changed recently. May be lawyers can clarify this.

You are right lots of my friends also told me that the GC is for Future employement and that you can work for another company.
I think the lawyers are better people to explain.
Since your situation is like mine did you lawyer tell you anything about when should you join your sponsoring company.

No. Actually I'm not worried about that now. I'm more concern on getting EAD & AP as soon as possible.

My employment based I-485 is currently pending through employer A. Can I take a few months off and go work for employer B?

Theoretically –yes, but practically it may not be a good idea. A green card is based upon a job that is in the future. You must join it (unless you are taking advantage of 485 portability) upon receiving approval of the green card. What you do before approval of the green card should not be of concern to INS. As a practical matter, INS would question this arrangement where you are taking off for a few months from the sponsoring employer. INS could doubt that employer A may not longer have a job open for you.
