CP or adjustment of status

Hi,

I am a US citizen and would like to get my mother permanently here to the US, many advised me to go in for CP as it's a safest route since my mother holds a tourist visa. I initially thought of applying for AOS once my mother is here (tourist visa), but there may be a issues arising later?

My question is:

If I go for consular processing, could someone please tell me in details how to process works and what steps I need to follow.

Thanks,
Ria

Someone entering the U.S. on a tourist visa has to have no intention of staying here and adjusting status when they enter. So the only way she can AOS here is if she has no idea you are going to apply for AOS for her while she is here, and then once you tell her she decides to stay here. They may question whether she had intent or not.

If you go for consular processing, you file the I-130 and when it is approved, it gets transferred to the U.S. consulate where she lives, and she goes through the process at the consulate and she gets an immigrant visa. The whole process takes around a year. When she gets to the U.S. she becomes a permanent resident.

That's not going to work, since SHE is the one filing the AOS. The OP has no say in the matter, legally.

Right, she is applying for AOS. The OP petitions her. The point is, if she has no idea she will file for AOS when she enters (because she has no idea the OP will petition her and convince her to file AOS), then it should be okay.

Hello guys & gals,

I would like to sponsor GC for my mom, who is currently in US for the past over 2 months. I need to know what forms need to filed wtih her application. Per my understanding I have file these forms

I-130
I-485
I-864
I-693
G-325A

Do all forms need to be submitted together at the time of application or any form needs to be filed at the later stage of the process.

Can I also file a travel document application with this package and do it need to pay any fees if filed along with above forms?

Do I need my moms birth certificate and what form requires that document? We don't have her BC so what are her options?

Appreciate your help here.

Thanks,
Soul
