CP Gurus, Please Help Us. Questions regarding AC140 Documents for Mumbai Consulate

CP Gurus Please help in sharing information regarding the
AC-140 Documents in Packet 3 to be filed in Mumbai Consulate.

Please help us in this thread by your experience and valuable information.

1) Letter of intent - does anyone have a copy of this letter that they can share with us. Lots of people dont know what this is and how it should be written.
Is this letter of intent same as Cover Letter for Packet 3. If you have a copy that you want to share please

2) what are the documents for the spouse to be included in Packet 3. Please help as there is lots of confusion in this matter.

3) If spouse is in India, do she have to take local PCC over in India?
Is it alright if she has not come to US on H4, can i apply her GC directly with my AC140 Process. Please help. Is there any problems by going direct CP rather than (first H4 and then CP).

3) Employment Letter, can anyone share the format for their employement letter send with Packet 3, there are some different formats going around, not sure which one is the right one.

4) What is the correct address for Mumbai Consulate, there were couple of them floating around. Please share the correct address.

5) do we have to send any photographs with Packet 3.
i.e any immigration photographs or marriage photographs.

CP Documents ....

Normal procedure to go for CP is specifying in I-140 that you will be going for Consular Processing.If you have specified that you will be doing adjustment of status while filing for I-140 then you have to apply for I-824 to convert form AOS to CP.Once you get the I-824 receipt you can send the complete Attorney certified package + Packet 3 to the respective consulate requesting for an interview.Consulate will then assign a case number for you and schedule the interview.

Note: In case of Delhi i have seen some posts where you can apply for AC I-140 even without I-824 receipt. Please check this site for the detailed posting.

If you believe that your case meets the conditions from link above , forward copies of your I-140 paperwork to the Immigrant Visa Unit, U.S. Consulate General, 78 Bhulabhai Desai Rd., Mumbai 400026 India

Regarding AC I-140 following are the documents:

1.) DS-230 Part1 for both Primary applicant and spouse
2.) OF-169 for Primary applicant
3.) Complete Attorney certified packet of I-140 and Labor certificate
filing
4.) Marriage Certificate (copy)
5.) I-140 approval notice(original)
6.) I-824 receipt (copy)
7.) Proof that you come under the jurisdiction of repective consulate
8.) Covering letter requesting interview for you and your spouse
Also mention you email address in the covering letter.Address to
deliver Packet 4 if you want to deliver Packet-4 at indian address

Once the consulate accepts your case they will send an email with the case number to the email addresses mentioned in the covering letter.
Once you get the case number you can expect the interview 2 months from the date you case created.Consulate will send an email once you are scheduled for an interview.

PCC is not required to send along with Packet 3. Yes is spouse is in India, then you need to get PCC from indian authority

No immi style photos needed for P3

Make sure you have alll the documents which are required at the time of interview, specially birth certificate/PCC from indian consulate (it takes time to get this).

AC140 - reason for hardship

Vincp:

I noticed that you are doing AC140 at Mumbai and since mumbai wants the reason - "waiting for the INS to process the change-of-status application would cause the applicant hardship".

I have been considering the AC140 route as well, can u please share how are you justifying the hardship. Thanks.

Covering Letter , CP Gurus PLease HELP US

Hi CP Gurus, Please help us.

We are in midst of applying or sending Packet 3. Can anyone share their Covering Letter Content as we are uncertain on how to state the 'intent'.

One more question, Do we have to send I824 receipt original or copy of the receipt in ok.

Please let us know as there is some confusion in the forums regarding this. Appreciate your help.

hi,

I am waiting for my 140 approval, and I have opted for
CP option while filing I-140.

Now if I have to go for AC-140 then is it possible or not ?
Is there anyone who has a case like this ?

Questions arised because AC-140 needs I824 receipt
and I 824 is to change from AOS to CP option, where as
I have already opted for CP. Can I still get I824 receipt ?

Another point was on Mumbai site it has following note:

Since you have already opted for CP in your I-140 application, you cannot take the AC -140 route to get LPR status. As you have already mentioned in your posting that I-824 is one of the requirements for AC-140 and I-824 is filed to convert from AOS route to CP route.

Your application will have to follow the normal CP route.

are cases where people have opted for
cp option and then went for AC140.
I browsed through and in following tracker
check the answers from LFG user, it seems
his was similar case, you must be familiar with that thread, since I saw your messages there too.

LFG did say in his posting that he had opted for CP when he filed I-140.

I-824 is usually filed for three scenarios.
1. To apply for a duplicate approval notice.
2. Request that a new US COnsualte or Port of Entry be notified of the previious approval of a petition.
3. Request that a US Consulate be notified that the individual's status has been adjusted to permanent resident.

Scenario 2 happens when an individual wishes to change status from AOS to CP. But it looks like LFG and his attorney made a clever move. They filed I-824 just for sake of it and got a receipt which is an requirement for AC-140. Since Mumbai consulate is satisfied with I-824 receipt, LFG case got through the system.

I think LFG was just lucky to get through the loop holes in the AC-140 process. Some consulates require I-824 approval notices to accept AC-140 cases.

I wish LFG good luck with his interview on Feb 19. I am sure he can shed some light on his case after his successful interview.
