CP Documents and Quick Question

Folks,

My 140 is cleared few days ago and It was filed as AOS but now I would like to do CP from New Delhi. I have got few questions

1) Is NewDelhi consulate accepts the receipt of I-824, I know Mumbai does?

2) I don't have any paystub for this year, have all the W2/tax returns/ etc of all the previous years. Does it matter that much?

3) If I do CP from NewDelhi ,do I need PCC from USA as well as from NewDelhi ?

4) If possible please list all the documents which I may require ?

answer: YEs NWD Consulate accepts I-824 receipt and hence the AC I-140 process.

Answer: This year means 2004? Generally it is good to carry last 6 paystubs. Last 6 from the time you leave usa for the interview - again this is recommended. If you have W2 for last 3 tax year you should be in good shape!

Answer: If you currently live in usa you need 1 pcc which is from the indian consulate in usa which caters to your region!

As kd said, it's definitely favourable to have the paystubs for the past 6 months. But from my own experience at the Delhi embassy, they do not ask for any paystubs, bank statements, W2s, 1040s etc. They only want the docs listed in the appointment letter (employment letter, birth cert, marr cert, PCC, and the filled forms). They even returned the Affidavit of support that I had filled for my wife saying they didn't need it. Having said all this, it's always better to have all these docs (I took them all). You never know if they ask for them during the interview.

2) Generally how complicated is to get PCC from NY CGI and how long does it take.

Answer: You need to enter usa within 180 days from your cp interview approval date. Sooner the better! I stayed for 5 weeks after my cp interview date! But the longer you stay you may get questioned @ POE about your length of stay. But at any instance your stay cannot exceed 180 days!

2) Generally how complicated is to get PCC from NY CGI and how long does it take.
Answer: Download PCC form from CGNY web site:

Fill in information, paste passport photos, include payment, include regular passport photocopies (need not be notarized) and mail it to the NY address on the form. The PCC process takes about 45 days. So once you haev mailed in about a week confirm with CGNY that they have received your application and then in another 4 week call tehm to inform that you are mailing your passport. Simple as that! 1 PCC is required per person. So one for you, one for your wife and one for any other dependents - use seperate forms for each individual!

Anybody else had issues because they stayed long?

I plan to have quite a long stay (abt 2mts.)

I am sure kd will give his experience.

But generally long absences from work are viewed with suspicion.
You should be able to explain the 2 month absence with some
plausible explanation. If you can carry a letter from your sponsor
indicating the re-joining date (date the letter close to your arrival date in US).

Even if you are not able to get this letter, you don't need to
worry. Just be prepared with some good answer if you face
this question at POE.

I totally concur with raju. In my case I had no issues with my POE except that the officer said welcome to my wife twice and not to me (??) Also I normally get 6 weeks vacation per year which is what i used so even if i would be asked i would say i was on paid vacation leave and not on unpaid leave. And touch wood, I had no complains about my entire GC process from start-to-finish since my entire process was completed in about 20-21 months which included the 3 months BCIS freeze back in 3rd quarter of 2002!
 
Oh! no. I would definetly be on paid vacation and working from other offices.

kd - I'm sure PoE office did not like your face at all :D
