the copy of the I 140 that the attorney has, need to be certified by the attorney and can be used for CP processing. check out the forums on Immihelp.com on AC I 140. It can be used only in cases in which 485 has been filed. it can be converted to CP after filing I 824 and then 1) can go via NVC which will take a longer time or 2) after filing I 824 can use AC i140 and mail it along with DS 230 and other necessary documents similar to packet 3 to the Us Consulate for CP. based on this the uS consulate can give a CP interview date. make sure that your attorney knows about this very well. or else hire an experienced lawyer.hope this helps.

Totally messed up. Nothing has happened. USCIS has pull out my I140 from their storage facility to see whether we requested CP or not. God knows how many months this will take. Since we did not technically file for AOS, I cannot go through AC 140.

if uscis thinks that it was filed for AOS, then you should use AC 140 and if it is CP go thru CP. never go for AOS. hope they pick your application fast. I would try to get help from local senators office to get this pulled out faster, since you might be loosing time...

Educate me. Doesnt FBI/name check happen in CP too? My lawyer called USCIS today. Apprently he was told that my I140 petition has been ordered by USCIS from their storage facility but USCIS has not recieved it as yet. I dont know how many months is this going to take. SO depressed.
