Coverting EB2 to Eb3

Hi All,

a) I had my labor field with my old company in Oct 2003 under Eb3.

b) I left my old company in May 2005. But while working for this new company I got a letter from my old lawer about approval of my Labor cert filed in Eb3.

3) I have 2.5 years exp(India) + 4 yrs (Old company in US for which I filed my labor under Eb3) + 1.5 years (Current company in US)

Now if I go back to my old company, is it possible for me to file my I-140 under Eb2 category rather filing under Eb3.

If you go back to old company, 4yrs old company experience does not count at all to qulaify for EB2

EB2 - Some relief in Nov Visa Bulletin

EB2 dates are available now PD 1 JAN 2003. Good news.

But EB3 still PD is 22 APR 2001
