Court certified arrest record

I have a DWI from 2005 and I have submitted the court certified record of all the charges and sentencing for those charges with my N-400 application. My interview is on Nov 17th and I am now wondering if "arrest record" also means "police report". In my formal request to the court, I used the same wording as in the N-400 application, but I was not given a copy of the police report.

This DWI is from another state and any documentation will take time to acquire. As a side note, I had submitted the same documentation for my PR, and the officer did not question anything. I am just curious if anyone has any information that can help.
 
USCIS wants your final court disposition in the case. The Police Records are only needed when there was some sort of incident and Police were involved but it went no further beyond the Police, not be confused with being dismissed by a judge. A dismissal by the judge would be a final court disposition. Also, not to be confused with a minor traffic violation which might end up on a DMV record that could be obtained from DMV showing that you paid the fine etc....

You mentioned that you submitted documents before. Was that the FINAL Disposition or merely the latest info available at the time. If it was an ongoing case during adjustment of status but became finalized after, then you would need the more recent record showing that you complied with the orders of the court and were discharged from any probation, completed any classes, paid fines or restitution, had no bench warrants issued, etc....

Unless the IO is picky, CIS is not interested in each and every nuance of the case. They want to know how the case was resolved, and court certified record should be sufficient. If they want more documentation, they will give you time to procure one. You might anyway want to request this right now to save time ... if you think the case was complex and this will help.
 
i got arrested back in 1998 and the IO asked for the copy of actual arrest from officer although i had certified copy from court so that delayed my approval about 2 or so weeks. Its good to be prepared
 
Thank you. I submitted final court disposition in the case at the time. This was 3 years ago. Officer did not ask any questions about the arrest or the outcome of the case.

Along with the DWI charge, there were 3 other charges - Following too closely, Improper lane change and Speeding. All of those were reduced to parking tickets as part of the plea bargain. The certified court disposition addresses all those charges.

Thanks. That was my understanding all along. Then I came across a posting and I started questioning my logic.

It is not for me to say whether the IO will see it as a complex issue or not, but given that all of them are addressed in the court disposition, I think court disposition should be enough.

Raleigh DO has one of the nicest officers and the Director for Raleigh office Jeffrey Sapko is a super guy, you will not face any issues at Raleigh DO.
 
If you send the Certified Copies with you N-400 application do you need to have another Certified Copy to take to the interview?

My friend of mine got her interview letter yesterday for Nov 30 VA..........she got two letters one is interview letter and one list of docment she need to bring in her interview day.........Is it normal ? i am not sure if some one mention about this list with thier interview letter.......seven weeks she got YL just to bring her state Id and GR.

Can you please tell the time frame of when your friend applied? I'm assuming her interview is in Fairfax, VA? I've been waiting for my interview letter at Fairfax, VA office and it would help to kind of get an idea of what the time frame other people are experiencing.

It is normal, not all people get the YL, it's usually send out to people that have recently moved to prove jurisdiction.

Could you please tell me where I can get the official, certified statement that says that I was arrested but there were no charges filed, thanks I really appriciate for your help.
 
Usually, you can't get a document for that situation. However, you can ask for a general police records check in most jurisdictions. Contact the Police Department that you dealt with and ask for their procedure. They will likely charge a standard fee and probably have a standard form for that type of request.
