Advance Parole and After GC process ...

Guys

Couple of things, I was approved last week and just left my old employer right before I got GC. My old employer is threatening to inform INS so...

Is there any case in this FORUM, who had GC approved and had problem later with employer complaining???

Secondly, my wife is still waiting her turn and if I apply for advance parole now how long it is going to take to get one, we wanna travel next month, would that possible?

I hope you didn't leave after you knew that the GC was approved or the USCIS could very well determine that you obtained your GC fraudulently.

Assuming that you switched before you got the GC, you should be ok as long as the new job qualifies for AC-21 but keep all documentation showing exactly when you accepted the new job since you could be asked to prove your case at some point (either due to your employer contacting the USCIS or at the citizenship stage). Alternatively, you could be proactive and file AC-21 now to try to head off any potential problems.

In theory, the VSC is processing AP applications in < 1 month (according to their online processing date). I don't know if this is really how long it's taking though.

I am not sure about being PROACTIVE simply because my salary is little less than my labor approval rate though I am working for STATE GOVT, however, I switched before I got GC and hoping my old employer was JUST THREATENING and will NOT do it.

Secondly, I heard this contrasting views on CITIZENSHIP stage, some said they only look at W2 and some say I don't even need CITIZENSHIP, anyway how am I going to handle at that stage if I chose to be NOT PROACTIVE.


Optimistically, will apply for AP for my spouse meanwhile. Honestly, I am not even sure that I might have already applied and we already have it because we searched my place and couldn't find it henceforth assuming that we didn't apply..

How do I find out that I applied or not? when we called INS they ask receipt number which we don't have obviously and they said ANUMBER or SOCIAL NUMBER will not WORK...

Yeah, there's little/no hard data on how often the government follows up on these things. Probably not often, but hang onto your docs (assume the old/new company might not even exist when you do your citizenship and prepare accordingly). You should be fine in the end, hopefully your employer won't follow through with their threat (did you mention that a) what you are doing is perfectly legal under AC-21 and b) they did get to have your services almost to the end of the GC process and at best you'd have had to stay for 3-6 months more anyway...).

Not sure about the AP thing -- maybe you could you use the FOIA (Freedom of Information Act) to get this information but that might take longer than you have. Also, your wife needs to be careful about travelling on the AP if she gets approved before leaving the US. The tentative conclusion seems to be that you should eventually be allowed to re-enter if this happens, but personally I'd seriously consider putting off the trip if this happens and getting the I-551 stamp (or the card) first.
