Counting days Outside the US

I couldn't find an older message thread and so I thought I'd post it again... how are days outside US counted?

For example: If a person flies out of US in the evening of July 1 and flies back in evening of July 10, is that:
a. 10 days outside the US
b. 9 days outside the US
c. 8 days outside the US

Thanks,

In order for it to count as a day outside U.S., a time period of 24 hours must elapse. In the example you provided above, the correct answer would be C.

It depends on how you do the math. The N-400 guide indicates that most "partial" days spent outside the US count as days inside the US. The one exception I can see to this rule is if you spend 25 hours outside the US, this would count as 1 day out, not 0 days out (even though you were in the US on both days). In your case above, the way I listed it on the form was to simply subtract the departure date from the arrival date, so my answer was b: 9 days. However, you would be fine listing as 8 days, and I will tell you that most IOs don't really seem to care, unless you are close to your limits of either continuous residence or physical presence.

USCIS guidance says partial days credit towards physical presence. In the example you give for a 25hr trip, you get 2 days credit towards physical presence, and a total trip length of 0 days. You still have to declare the trip, but it doesn't impact physical presence.

I believe I have read about partial day in US not counting towards days outside US, but I am not sure where I have seen it.
(So in the case above it would be 8 days - excluding July 1 and July 10)

Can you point out where I can find this information?

Here is a xxxxxxxx to count days of trips outside of the United States for naturalization application. The calculator accounts for partial days spent outside of the United States.
