Hi,
I am planning to take H4 visa after working for 3 years on my H1. And also got the Visa extension from a new employer in November 2008.

Usually I get my pay slip with 30 days gap from my employer. Meaning right now this is March and I will be receiving my January 2009 pay slip and it will be the last one I will be getting as i m done with my project ending on 31st Jan 2009.

Is it ok to apply for H4 with in few days in this month (March 2009)?

If I have to apply do I have to consult my employer and go through with him only, and how much would be the processing fee for changing my status?

OR Can I apply with any attorney's as well?

Your response will be very helpful and will be very much thankful.

explain what visa petition you got approved from new employer B. also provide details of your present employer H1 and your I-94 expiry date.

do you have spouse on Valid H1 status? till what date his I-94 is valid.

you should contact lawyer with your full details and copy of all your papers. you did not post full info.

Hi Ginnu,
Thank you for your reply. It is a PETTITION FOR A NONIMMIGRANT WORKER.
Class: H1B. My H1B and I-94 both are expiring at the same date 2011.

My husband's H1B and I-94 are expiring at the same date 2011.

Please let me know,
Thanks,

If you have been on H1 B status and your spouse is on Valid H1 status then you can file H1 to H4 change of status now with USCIS. You can apply directly (form I-539) or can use any attorney.
