Converting from OPT to H4!!

Hello,
I am in OPT that is valid till Feb -9- 2007.I have not applied for H1 visa this year.. as I applied for I-485 and EAD under my husband's GC process.He is the primary applicant and his I-485 and I-140 are in the processing status.I applied for I-485 and EAD on September 15th 2006 but did not get any acknowledgement from USCIS(Receipt number).(They already lost the application and documents once in july )

My question is ... will I get the EAD with the time frame I have as it takes 90 business days for approval of EAD after we get the receipt number? or will it be advisable to transfer to H4 as a dependent to stay in status for the GC process?? And if converting to H4 is a good option then how many weeks before should I apply for H4 before my OPT expires..

And I understand that we get a receipt number from USCIS for each case type.. so does the receipt number imply that H4 is approved? And I am currently working in OPT so.. if I get the receipt number should I stop working for any company!!!!

My last question is how long does it take for converting from OPT to H4(Is it advisable to apply for H4 now?) and is it true that once I get the receipt number I am converted to H4 or I will get into H4 status only I get the approval notice from USCIS?

I will really appreciate your advise for my question.Please help

I think H4 is safer than OPT as OPT is based on F status which is not allowed immigration intent. There is some thought that F status will void after I485 is filed, though it is not confirmed by authority.

receipt # does not mean approval, but question in your case is OPT is still valid or not after I485. I recommend to talk to lawyer to be safe.

Should be after approval.
