Hi friends,

I finished my masters in electrical engineering in U.S and i joined a consultancy, i am in opt status. he made me to sign an agreement for 1 year and need to pay $20,000 if i break the agreement. now i got a job with 2 layers between client and my consultancy, my employer said he is getting very less and told me there are 3 layers between him and client and he is paying me very less he is not even running my pay roll. i came to know that he is making more than double than what he is paying to me. i asked him to file my h1 now he is asking me to sign one more contract for 18 months for very less pay.

can i move to other consultany and file h1 with other employer. will that agreement which i signed will create any kind of problem.

Why u want to work with such company after getting MS from US and a sort of exploited. You should work in a better company. Such people will never value desis. I heard stories about Tata consultancy getting money back from employers when they got tax return check and cheap health insurance.
My suggestion is you should change if you get better elsewhere.
 
Talk to a lawyer. Unless the agreement is for the fact that the employer paid for your training, I doubt US laws allow for "bonded" labour (even Indian laws dont allow it for a long time now). But if your employer has paid for your training and requires you to return the money associated with training (as per the terms of letting you have that training) then I believe that is allowed -- but talk to an attorney.

I can understnd your dilema as i was in your shoes five years back. Just remember ...Just because you signed a document that does not become LEGAL. He can not bond you even if he has non competetive or non disclosure agreements. He has to prove why u have to pay $20,000. meaning what type of expenses they encountered for example training...and they have to prove those expenses. Most states have laws favoring emplyees.

More the less from what i can understand in ur posting, your employer will be in more trouble if he is not running your pay roll and paying by other means. And also if he violate any conditions he mentioned in your offer letter then whole contract can be void. From my experieces these people don't even know how to write an agreement( most of times they don't go to an attorney and simply type some thing on agreement to save money) and if you are an employee to that company then he has to pay the amount mentioned on the offer letter.

All they can do is they can send u a letter saying u have to pay them and i doubt even if they take even that risk. In case if u get just go to an Attorney with all evidence and they can draft a response and after that they don't even dare to contact.

Good luck and remember H1 quote is going so fast and make a wise decision. Don't let those greedy people control your professional life.

Depending on your state, such contracts are deemed invalid. Exit penalties are invalid too. If you think your employer is engaging in unfair and unethical business practices, you have the right to complain to the DOL.
