Contract from Canadian company.

Hi all!

I am a Canadian working in the USA under a TN visa. I know I can't work for any other American companies (unless I get another TN visa for them) but here is my question.

The Canadian company where I used to work a couple years ago wants me to do a little project (20 hours) for them since I know the system. Can I legally do that from here?

There is grey area in this. However, in order to have even the possibility of this being legal, the you and the firm you work for must satisfy these 2 criteria: (a) they must not have any other US presence, and (b) neither they nor can be benefittting from your presence in US to do this work.

That Canadian company has only one office and it's in Canada. Also, the fact that I'm in the US is not an advantage for them. The reason why they want me to do it is because I know their system.

In that case, would I pay taxes on that income when filling my next tax return here in the US?
 
As a person living in US, you would are reporting every penny you earn anywhere on your 1040, right? You would also be subject to withhoding in Canada, but should not be taxed in the end.

Where can I find more information regarding this? I'm hearing mixed information everywhere I go and I'm hesitant to hang onto my foreign contract because I don't want to lose TN status..
