Contract/Agreement for Green Crad processing

Hi Everyone

I had a few questions. I work for a company with headquarters in Georgia and a branch in Sunnyvale. I work in their Sunnyvale branch. For getting the GC processing stated, they are asking me to get into a contract which says they will pay only for first $5000 and I will have to take care of the rest of the expenses. Moreover, the agreement also says that if the employment is terminated within 2 yrs either by me or by them I will have to pay back whatever amount had been spent on GC till then.

The question I had was:
1. Is it legal to get a contract/agreement signed in California. As it is mostly at-will?
2. Has anyone experienced any problems in signing such a contract?

A reply would be highly appreciated.

The company has the right to ask for a contract. However, whether you will sign it is entirely up to you. If they cover only $5000, and you cover the rest of the expenses, this is illegal. You have no right to pay anything for your green card process, so even if you sign this contract, you cannot mention it or use it. If you decide to sign the contract, please have an attorney look at it. And the attorney has to be your attorney not the company's. Also you have to be careful that there are paragrafs in the contract saying who controls the process. Because if the company makes you sign the contract, and then they control the whole process, and they hire the attorney, they control the advertising, then you may have problems with them spending excessively. Also in the contract there should be a paragraf what happens if the GC is denied, then you still owe $5000 to the company and all their other expenses?

This is incorrect.

To our original poster: I would insist on my choice of attorney.
