Continous Residency... Help Needed

Hi Guys,

I would like to know if i qualify to file my citizenship next month. I have been out of the US for a total of 478 days in the last 5 years.

My dates are as follows.

GC - 11/20/01
OUT 12/04/01 - 05/31/02 = 176 days(5 months-26 days)
OUT 06/09/02 - 10/24/02 = 135 days(4 Months-15 days)
OUT 11/08/02 - 03/16/03 = 128 days(4 Months-8 days)
OUT 10/31/03 - 11/04/03 = 4 days
OUT 05/27/04 - 06/20/04 = 24 days
OUT 12/31/04 - 01/11/05 = 11 days

I have been in the US continuosly for over 40-months so i guess i qualify under the physical presence. I would think i qualify for the continous residency because i was not out of the US on a trip longer than 6 months.

Do i still qualify to file next month on 08/20/06 (4Years - 9months)

Help needed guys :confused:

Based on the data you presented, it looks you qualify on continuous residence. I was out a total of 464 days, with several 5-month trips, and never had to answer any questions about those trips during interview. My wife was out 468 days and also had no trouble.

I'm really not sure what the scoop is regarding applying 90 days early. I know the rules allow it and others have do so, so I'm sure you'll be ok.

90 days rule is not a scoop but a published guideline by USCIS.
 
Anybody out there out from the US for more than 500-days within the last 5 years of N400 application. :D

There are a few people...but all their visits were less than 6 months,incluf...i have been out for almost 250 days,including one for 172 days...no questions asked in the interview...she just checked the dates on passport to confirm if all the trips were less than 6 months...
 
The IO checked my passport too, but didn't find much since not all entries were stamped when I arrived back in the US. (Arriving by sea appears to be different than arriving at an airport). My conclusion? USCIS really don't mind what's NOT in the passport, but they might get upset by something they see IN there.
