I have been a Lawful permanent resident since Dec 2000.
I was out of United States between Feb 2004 till Nov 2004.
I will be eligible to apply for citizenship later this year. I satisfy all the conditions except the following one where I need to show proof that I have not abandoned my residence here in USA.
THe law states that "(b) Absence from the United States of more than six months but less than one year during the period for which continuous residence is required for admission to citizenship, immediately preceding the date of filing the application for naturalization, or during the period between the date of filing the application and the date of any hearing under section 336(a), shall break the continuity of such residence, unless the applicant shall establish to the satisfaction of the Attorney General that he did not in fact abandon his residence in the United States during such period."
I spoke one of the lawyers at the Murthy.com she gave the following things which are considered as proofs of non abandonement of residence.
1. File IRS taxes for last 5 years as resident. -- DONE
2. Own a home -- I dont own a home.
3. Any rent receipts during the period of absence. -- I dont have any rent receipts
4. Maintain address during your absence. -- I did have a address while I was gone.
5. Maintain Credit card -- I did maintain my credit cards
6. Maintain Bank Accounts -- I have all my finances invested in US close to $200000
As I dont have 2,3, can anything be done on that regard. Recently we thought of a plan where in we can buy a piece of land for few thousand dollars. This property could be a wooded land or could be in the deserts. It will not be costing too much money.
Is that a good idea to do so. I understand that the piece of land which is being owned is after my return to US.
Anything else needs to be done let me know.
