Consulate took my papers. returned my passport..

Hi, I almost at the same situationa as you are, except they have not (yet)deny my visa. They have all my documents, returned my passport and asked me to go home to wait for their "call". As stated in a marked sheet given to me, my application needs "Further Administrative Review" and the processing time is within 15 working days (excluding Saturday, Sunday, all local and US public holidays!). It\'s been almost a month, since June 6, no news from them.

From the info found from various websites, Administrative Review usually means they have concerns about the authenticity of the information presented and may be writing to the INS to withdraw the H1B approval notice. Sometimes, the INS agrees and sometimes they don\'t agree. If it a factual issue, they may agree with the consulate or Embassy.

I\'m so afraid that will happen to me, all my documents are sufficient and they do not have any legal ground to refuse my application, though they mentioned (once I called to ask for status) all kind of applications are very subjective.

The following is my experience.If anybody had this type pl share this.

I have appeared for H1-B visa at chennai consulate in the last year July 2000.
They sent me a query form asking me to submit
Inside, outside photographs of present and past compnays
US company photographs and its tax returns
Paystubs
Reference numbers of co-workers of present co...etc

I have submitted all the queried information..and i was called for interview with consular officer.

Once the interview is over with few questions like what is your name and what is your qualification and ..etc they told me that my case needs furthur investigation and so my case was reffered to AFU.

After a year i have received a letter from consulate asking me to submit the followign docs thru mail.

passport , DD for visa fee , copy of I-797 and I-129 forms ..etc

So in the next week i am going to submit the above docs...

I wish you all the luck. Are you in IT field. Why did the consulate took one whole year to respond. I think yours will be through as they have asked for the passport and other details. do not worry. Did you get 221(g) mentioned in your passport? I have my pasport with 221(g) and the original H1 with the embassy.

  i came to US on h4 & got h1 done from a firm here. i want to get my h1 stamped from washington. what do i need to send alongwith my passport?

H1 Cannot be stamped in the US if entered the country with a different Visa

Your H1 has to be stamped outside the US. You can get it done even in Canada
