Consulate took my papers. returned my passport..

Hi everbody,

I am a H1B petitioner. I had gone to the consulate at NEW DELHI for the visa. The consular took all the documets but returned my passport alongwith a notice which says the reason for visa being denied. Even though the visa is not yet rejected, I have been asked to wait. It has been more than 2 weeks since I received any info from the embassy. The visa is being denied under 221(g). I want to know if anybody has gone through this experience in New Delhi.

My background is in software programming. yes, the evaluation papers were there. I want to know whether someone has faced this problem and how long did it take him/her to get reply from the embassy.

I am still waiting for some information from the embass. I would be more than happy to share the experience with everyone. There is no use calling the embassy as they dont really help you. the only solution is to wait.

Today I came across your problem and let me share some of my previous exp instead of asking several unusual questions.
I have been in US for more than two years.
For first time when I went for H1 stampping in calcutta consulate in 1998, they with hold my visa on 221(g) ground and asked me to contact my employer in USA for additonal papers like company finance papers,tax,bank statement etc.
I was so upset but believe me after 2-3 weeks(if I remember properly) I suddenly got a call from US consulate and they asked me to come and take the visa stamp.
After a week I went there and I got the visa without a single question asked.
So do not worry,try to contact your employer. Also I do not know whether they told you the proper reasons and asked for any extra papers.
Do not worry - that is not the end of the world.
I know how USA is - stay cool - this will help you.

Hi, Guy needing help:

I had a very similar experience (as Arun Das\'s email)at Montreal Office. They gave a letter saying they need more info and visa delayed due to administrative reasons. I have been in US for more than 4 years and have a MS degree from here. I am still waiting for their so called "PHONE CALL". Any develeopment please let me know.

I am in a similar situation, is it 3 to 4 weeks or 3-4 months. Also, would a letter from employer stating that I need to travel immediately on a business trip help.

You know the feeling, damn these consulate guys.

hi... what is the outcome of your situation? i am on the other end of this scenario. i am an employer who is wanting to know what all i need to provide to make the consulate happy. i am beginning to wonder why the INS is even involved if the consulate has to redo everything.... government!!!!!!!

Well, it\'s been more than 5 weeks and I haven\'t heard from the embassy guys. I did fax a letter from my employer indicating that I need to travel, but... as we all know their capabilities. A freind of mine who was in a similar situation got a call from the consulate guys after 2 months, so I am hoping for a smiliar time frame.

Will post here as soon as my case is resolved.

I have no idea, infact I had all the documents they needed. I have a MS degree from here, never been out of status, straight from school to job. My guess is they are checking the company\'s status, as in their financial and tax statements which by the way is about $2 Billion (it\'s not like the company is trying to pull a scam). I think they pick applications on random to check, if the system is working.

I went to the consulate office at Montreal, Canada.

I am starting my GC now.. I am not sure of the merit/demerits of the consular process over AOS. If anyone can give me this info, it will be great. depending on this i can go Consular or AOS... I am from India (Hyderabad), so i will need to go to chennai.

my case is in a horrid situation right now. the attorney sent the all the original papers but they havent arrived. tracing them has proven unsuccesful as the system says not found. we are frustrated to say the least. he was hoping to go the first of next week. i sent info by global priority on april 3 and it arrived on the 12th. she sent hers via global priority on march 29 and so far nothing...anyone have any suggestions?????

Guys: Finally some good news..
Looks like my case is resolved (after 2 months). I have been asked to pick up my visa stamp at the embassy (I will do it on monday). The reason for delay... my name is too common and matches with the names in the database used by the embassy to track criminal activities. hence they had to verify that I was not the guy they have been looking for. Seems a very simple job to me... ask few question, look at the documents... Oh Well !!!.
