Consulate Processing in India ..Please help

Dear Friends,

I applied for Delaware Federal labor in July/lastweek/2002.
It has been approved last week !

It tool almost one year to get my labor work, I did a major mistake when I gave my paper work to American lawyer in FEB 2002 she applied in Regular process (NON-RIR) case most of them got labour in 6 months after they applied in RIR case but for me it took 1 year to get approval.

And I don't want to make a big mistake again, I am ready to take risk and want to apply for consulate process.... Can any one of you expain me how it works and How I should apply for it without delay...

I have to apply for I-140 next week, Do you advice me going through Consulate Process or Regualar process in USA. I am ready to take risk in going to India for Consulate process.

My friends told me that if good to apply I-140 and it seems it takes 3 months to get approval and then go to India and apply for i-485 in the same day in the consulate process. Is this true??

Since we people suffer a lot from this US Immigration. Is always better to take advice from your experiences and that's why I also what to exchange my hard feelings for the last 8 months for this mistake I did with my Attorney !...

dont blame lawyer and your delays

Its common now a days to get labour approval in a years time. At least you are lucky, there are scores of people who are not that fortunate where in which they are getting querries by applying in RIR without proper ground work and hard realities.

Coming to your point, PL browse all the threads for you to understand the complete process of CP & AOS(485). You will get a really good Idea. If you fall in US consulate in Chennai, then you have regular cp process only , whereas for Bombay & Delhi there is AC140.

pl dont pose a Q, whats AC140?. Read all the threads in this tracker. you will know.

Thanks ....I will go though all the links tonight and in the weekend !.. But please advice me the following.

1) How long it will take If I apply consular processing to get Greencard (Just guess), Since people say its risky to deal with Consulate Processing and Regular processing....How may months difference it will take.

2) My passport is from Hyderabad,Can I apply for Mumbai and Delhi.

I have to send the paper work with in 3 days for applying I-140. so your advice is very important.

One step at a time!

As SRI-IL suggested browse the forumns and you will find more
information than you would need.

Coming to your specific questions:

1) You have got your labor just now. So the rest of the process
involves, filing for I-140, Approval of I-140 , and rest of the
process through NVC and the Consulate. Since you belong to
to Chennai consulate, AC 140 is not an option for you.

An estimate:

a) I-140 filing : In you hands.

b) I-140 Approval: Normally 2 to 4 months. I have seen cases
approved in 22 days and those waiting for more than an
year.

c) Rest of the process: INS --> NVC --> Consulate:

5 to 9 months.

2) If you were a resident of AP and the passport was issued
in Hyderabad, you have to go to Chennai consulate.

If you decide to go for Consulate Process, then remember to
check the option for 'CP' in your I-140 petition.

delayed labor?

dude, your attorney seems to have done a good job. maybe delaware is faster. 10 months for labor approval is good by rir standards currently. i know several people who have been waiting for almost 1.5- to 2 yrs in rir category. as for ahead, depending on your risk tolerance, you can do cp. however, if you are filing 140 you can also file for 485. 485 processing is about 15 months in vsc. so looks like it might take the same time for you for cp or aos options. ask your attorney.

Birth Cerificate

Thanks a lot for your suggestions, Does any one have Affidavit for the Birthcerficate, I have appied for Birthcetifcate 4 months back but not yet received and it may take time, It seems there is some secondary way of applying in place of birth cerificate...
