I went for AOS after my I140 approval. But
CP now looks more and more attractive. Man! It seems I made a mistake by going to AOS but time will tell
Hey, I would appreciate if anyone can answer this question. I'm (primary applicant) from Chennai region and my wife is from Mumbai. Where should we go for interview

I would have said you both can appear at Chennai Consulate.
But there is a catch here. Since you are already in the line for
AOS you need to file Form I-824 to bring it to the CP route.

With the Mumbai consualtes you could have just filed the I-824,
collected the receipt and filed an AC 140. But Chennai does not
accept the AC 140.

In this situation, what you can do ( my opinion) is, talk to your
attorney, file the I-824 and send an AC 140 to Mumbai. If they
accept your application by virtue of one of you belonging to that
Consulates's jurisdiction, then you would be saving a lot of time.

Thanks Raju

One more question. By applying for I 824, do I lose my AOS processing i.e. will it be discontinued and If so then what will happen If mumbai consulate will not accept my AC-140. Does this mean that I would have to reapply for I485 or wait for my I824 approval.
Your replay is appreciated. This whole GC journey is getting very tiring and annoying. I just want to get out of it.

I have not read about any case where it has been rejected by
Mumbai consulate. However what you raised is a valid point and
you may need to research a bit about this.

Hmm... That's interesting. In my opinion I believe that the jurisdiction of the primary applicant is what it counts. Hence your case will be forwarded only to Chennai consulate.

The reason I presume this is that, I remember very well when I asked NVC as to whether I could forward my case to Mumbai instead of Chennai, they said that the case would be forward *ONLY* to the consular district to which I belong. But in case I am spouse of a *PRIMARY* applicant and I am doing either joining or follow-to-join my spouse then my case will be sent to the consular district of my spouse ie the primary applicant.

Again, this conclusion is entirely mine based on the above conversation with the NVC staff.

Hope this helps.

Cheers,
Ganesh.
