Consular Processing

I am currently on H1B and will be filing my I-140 soon (PERM approved). If I choose Consular Processing and I leave the US and the employer for good, can you still apply for green card with approved I-140 when your priority date becomes current?

If company X files my PERM and transfers me abroad and I work in a new country, can I use consular processing to get my green card if I still work for company X?

- No. Your new employer has to file PERM and I-140 again - and you can re-capture your PD from the previously approved I-140.

- Yes.
