Hello,

I am working for visa company and my GC is getting processed with other company as Future employer.
Sponsoring employer has asked some money if i do not join after getting GC.
Since future employer is body shooper and also currently i am working as permenent. What is i just pay the money to future GC company after getting GC and do not join them but continue with the current compnay?

Please suggest..
Thanks.

In that case both you and the sponsor are commiting serious immigration fraud.

pay the money and file you 485 and after 180 days chage you intend to join . Though what u r sayying is wrong but i guess everyone will do it. Make sure you get the copy of labor certificate , 140 and 485 . Then after 180 days of 485 days u can file for AC21 and change your intend. This is not rite but this loophole has been created by INS only cause they fail to adijucate the 485 in 180 day. I had read couple of cases on this forum who got approved like that.

All Gurus & Members,
if Sohel used AC21 then there should not be a problem if I am correct, using AC21 one can tell INS this is my permanent employer.

Thanks,

I have talked to attorney about a similar possibility and he said that there should not be any problem if you send letter from
your perm employer after 180 days.

What do you say nkm-oct23? I am waiting to hear from you.
I started my labor from curent employer also. But It has been just started and if i have to go legally ,I will get my GC not less than 8 yr. with current timing so i talked to my previous employer who has my labor cleared before. And continued... Got approved for I140 applied for I 485 and now it's been 20 months still waiting...
