I self-petitioned for EB1(EA) and have received an RFE recently with
the standard form letter asking me to resubmit additional information.
The reviewer
commented that "it looks like you are a highly talented, up and coming
researcher" but you need to prove that you have reached the very top
of your research field.

How do I answer such an RFE? I have read several posts on the Web
about such issues. I am looking for a place that has consolidated
information about dealing with RFE.

I know the obvious things to do are:

- Get letters from "unbiased" referees who corroborate that you have
reached
  the top in your field of endeavor.

- Add more information on each of the publications, the statistics
about the
  publication (how often is it published, whether it is
International/National,
  Acceptance Rate).

- Submit new evidence with regards to publications etc.

I would appreciate hearing more information.

I will create a Webpage consolidating all the information dealing with
EB1/NIW RFEs. Any information about individual cases with/out success
will be valuable.

I had the problem for a NIW REF, asked very difficult questions related with "New York Dept of Transporation",such as "if a labor certification were required, how could the national interest be adversely affected?" and question of "serve the national interest to a substantially greater degree that would an available U.S. worker?".

A friend of my in our lab recommended that web site and I found the NIW RFE questions and good answers in its "Do-It-Yourself" package. As I remember that there some EB1 RFE samples and information in its web site.

I have sent my reply and response to the RFE a week back and am now waiting (and praying)...

I got RFE for my EB1-EA

I just got a very general RFE for my EA from NSC.
I got 5 reference letters, 3 citations of for my papers, add one submitted paper and plan to send out in 2 weeks.

DRGR: did you send the response using their small envelope specially for RFE? It cannot hold thick letters. Also did you also use the previous arguments in the RFE response or just use all new additional evidence? My RFE reply is around 11 pages which will include most of the words I used in my initial petition.

Any suggestions would be appreciated. I\'ll update the case.

I sent the RFE Response in a big envelope to the Overnight Address of CSC. I did not use the small envelope. I however marked the Cover of the Envelope as Response to RFE and put the Notice of Action (RFE) on top on my response.

I listed all the points raised by the RFE and answered each of them point-wise (proving that I have reached the very top of my field and got international recognition).

I got another a dozen expert opinion letters from people that I have not worked with and put excerpts from their letters and emphasized the portions that made the above point.

In the remaining points, I used additional evidence, re-used and corrobrated earlier evidence and re-emphasized the excerpts from their letters which supported that specific point (for example scholarly publications).

I put all the evidence as appendices and numbered them and referenced them in the main letter. My main letter was around 30 pages - basically because I quoted from the letters a lot (most of it).

I sent in the RFE Response and am Waiting and Praying.

Thanks for your kind reply. Did you also send RFE with the old supporting materials, such as letters, papers which you alreday provided before, plus new materials? Or just quota them again without resending those old documents. Pls let me know.

I had sent a huge bulky packet earlier (with all my research papers).

EB1(EA) Approved at CSC

I just heard that My EB1(EA) has been approved at CSC on 01/08/02.

Here are my details.

- PhD in Computer Science (1999) in US.
- 5 years experience including 2 years in India in top
  Research Labs and Promising Stratups
- 35 international papers including 10 journal papers
- Editorial Board of three international journals
- Program Committee Member of over half a dozen conferences
- Invited Speaker and Chair of Conference Sessions
- 30 letters of reference (15 before RFE and 15 after RFE).
  Letters from Former Colleagues, Supervisors, Independent Reviewers.
  From Around the world.
- Self Petitioned/No Lawyer involved.
- Earlier had got my EB1(OR) a year and half back. I left the job to join a startup after my I-140 approval (Bad Move:-( ).
- High Salary.
- Regional Awards and University Awards.
- National Awards in India.
