I filed my I-485 based on my self-petitioned NIW I-140 to TSC in 6/01 (ND 7/01) and did my finger print in 1/03, after numerous calls to TSC. I was living in CA when I filed and the reason I filed with TSC was my attorney told me that I should file with where my I-140 was approved, which was only partially true, as I later learnt. If I had filed with CSC, my case would have been approved long time ago. I also have a second employer sponsored I-140 approved in 1/02 but most attorneys told me if I were to file a second I-485 with CSC, I would confuse INS and may cause unnecessary delay. So I had to watch my second I-140 wasted, after I myself spent a lot of attorney fees. I should have filed another I-485 with CSC and withdraw my first I-485 since CSC at least is more predictable and has more potential catching up. Anyway, enough regrets.

Now my case is torturing me as I am stuck with my current position without green card. My question is if it helps I contact local congressman. Even if my case is 7 months behind what TSC is saying (12/00), quite some people filed later than me already got approved. Has anybody tried seeking help from congressman and if so what are the results? Is TSC going to put you on their "blacklist" if you ask congressman to find out how inefficient they are?

After read your post, I have a question to discuss with you and also invite other fellows to join our discussion.
I talked to my attorney a few days ago. She told me that I-485 is low priority in TSC now. So it is possible to wait much more time to get your green card approved in TSC.
If you file another I-485 with CSC and withdraw your first I-485, how about your EAD situation? Can you file your new I-485 and EAD now, and withdraw your old I-485 and EAD after you get your new EAD a few months later (assuming your H1-B is expired now)?
We don¡¯t want our employment interrupted.
 
More than a month ago, I sent an email to my local member of congress. To date, no reply.:rolleyes:

Random approvals is the norm in TSC rather than an exception. Contacting a congressperson does not put you in the blacklist. Some congresspeople reply and some others don’t reply. Don’t expect miracles from them. Since your date is July 2001 you will get a reply from the congressional office saying that TSC is processing Dec 2000 and they will ask to wait for your turn.

But perhaps you can write mentioning about your case in addition pointing out the delays in 485 processing. Hopefully enough complaints generated will create some action. Living on hope has become a habit for folks at TSC. Good luck.

My company was asking me if they could push my case by talking to the senators. So i went to my lawyer and asked if we could use that route. Guess what his reply was: he said that if INS (BCIS now) finds out that there is outside meddling (exact words!) they will deliberately delay it. And also said he would back off from my case if we went that route......:mad:

I'm amazed that a lawyer would claim such nonsense. Find another attorney.

I did not apply EAD since I still got almost 3 year H-1 left. I applied AP once but did not use it for my travel last year as I got a H-1 visa at that time too. I am a Chinese too.

I heard all kinds of different sayings about congressman help and that is why I am asking for your comments. I am also worried that since my case is behind what TSC is saying to be processing (12/00), it may not help me much to ask for congressman's help now. Also, BCIS operation is a black box operation and nobody really know what is happening. If they intent to screw me up, I have no other way to know either. Either congressman interfere they may just say "sorry, I screwed it up, let's do it again".
