Hi, I am an
EB3/I485 June 2003 case

I got RFE for legal status in March 2005 and I responded in April 2005.

I just realized that I got a message on September 13th as:

On September 12, 2005, we responded to your request for more information concerning your case. If you have not received our response within 30 days from this date, please call customer service at 1-800-375-5283

Anyone knows what this message means? Do not have very good feeling about it.

Thank you.

Looks like the message is in response to one of your queries... Did you call customer service for your case status or did you send any letter to TSC asking about your case..or did senator/congressman acted on your behalf regarding your case...

Don't worry it is common msg, which is triggered by

1. Address change
2. If u call and made case Inquery , or went written inquery.
3. if ur attorney call and made inquery or written inquery.
4. U contact to Congressman/senator and asked helped.

Few ppl receives simple letter telling current status, many never received. so don't panic and relax.

Good Luck

thanks for the response

Hi, All, Thanks for the response. I lost a bit touch of reality when I saw the message. I did ask Senator's office to inquiry my case back to early September.

Oh well, to be more precise of my case
EB3 June 2002(not 2003 as in my initial post)

PD should be June 2000 (when my labor was filed).

Anyway, for your information, I spend 28 minutes holding, and finally asked an CSR, nothing special. She told me to wait for 30 days.

Here is another question - I bet pretty unique among applicants.

My original lawyer who filed my I485 closed his firm because he was terminall ill. He sent me all the original paper before he closed his office. Now should I transfer this to another lawyer? (I already changed job, and used another law firm to file EAD/AP/AR11 etc).

If u are saying that USCIS has ur pending 485, and ur Old attorney filed and since u don't have any attorney you didn't take any action?

Dear Friend, if above assumsion is correct then your first periority should be to inform USCIS that who is representing ur case. otherwise USCIS will fwd all doc like FP/RFE and all other to ur prv-attorney address.

what to do?

Well if u are willing to go through attoney hire new one and ask to file G-28 to represent ur case.

Or if u are willing to go by yourself wihout attorney then YOU file G-28 mention ur name in it that ur represent ur case by urself with ur address, and attach a letter to explain.also attach pending 485 receipt or any other petition is pending filed by old att.

DO NOT WASTE SINGLE DAY if they issue RFE you have no idea what pain u may go thorugh to get it.

Good Luck

which lawyer

Hi, POJ,

the story is this: I changed job this year Febuary, and the other company filed AC21 portability letter for me. So I assume they took over my I485 case naturally because they did file inquiry for me along the way. In May this year, my original lawyer sent me all the packages claming he is closing his firm because of health reasons.

I changed job again in September to another company. The second law firm exchanged emails about continuing represent me.

>> The second law firm exchanged emails about continuing represent me.

Wouldn't it be good instead of assume, Ask that law-firm to send/fax u copy of G-28.

My understanding is 485 is ur petition and unless u auth them and u sign G-28 for them they won't.

Good Luck
