Isn't DOL supposed to be a federal certification, independent of state-specific concerns on industry (as against SESA where different state agencies can have different yardsticks)? So why is only California DOL treating IT labor petitions differently, and all the other DOLs (Chicago, NY, Phily, etc) certify the same petitions without any problem? Don't all DOLs get the same set of criteria for evaluating and approving the petiions? Can someone explain? Thanks.
 
DOL is region based.. It also can look back to state where labor is applied & look for market condition / industry position in that state. Most of the applications received by CA DOL comes from California where IT industry is Severely affected..

That explains! Though IT industry is affected almost uniformly across the country. Probably because IT industry is concentrated in CA, the impact is blown up.

usnycus, the difference is that CA DOL is giving a NOF or RFE on almost all IT related petitions, whereas other DOLs are certifying the petitions without much problem.
