hi...i am struggling to work out what is the best visa option in my case...i am an australian citizen currently living in china...i have been offered a job with a major corporation in the US starting in spetember...i am engaged to be married to a chinese national and we plan to marry within the next month or so...my question is, what is the right visa category for us to use?...my job in the US is not a temporary position...should we marry before i formally accept the offer and the company submits my visa application? any help would be gratefully appreciated
 
The company will decide the visa category based on your qualifications and the type of job. Most likely it would be the E3 visa, but it could also be H1B or O1 (extraordinary ability) or L1 (if the US company is a parent or subsidiary of the company you're working for in China). Read up about those visas and talk to your company about which type of visa they plan to file for you.

Whichever work visa it is, it will allow your spouse to get a visa to accompany you to the US, regardless of whether you marry before or after getting your own visa. However the timing of the marriage may affect whether your company decides to pay for your spouse's visa.
