Confused...Your help is soughted (Two notices for my 485 application)

Hello All,

Few months back, I submitted my 485 application packages(I-485, I-765, I-131). I waited for more than three months to get receipt notices. But didn't get one. In the mean time, I got married . So I again submitted my 485 application package. This time with my wife as dependant. Just after submitting my second application package, I got the receipts for my first application package. I also got my finger printing notice. Now I got the receipt notices for my second application packages . my wife also got her receipt notices. I got confused and would like to hear your advice on this case.

I contacted a couple of lawyers and their advice was to consolidate the case and keep the first application and merge the second application with the first one. That means withdrawing my second application but attaching my wife's application to that of my first appliaction.

But when I contacted the service center(Vermont), they asked me to withdraw the first one and continue with the second one as the second one has my wife as a dependant.

I am confused, which path should I take. In the mean while should I go for finger printing for my first application?

I still don't understand why did u submit I-485 second time. u should definately follow up INS for receipt or any other option( e.g. u should inquire about cashed check ).

If i were u, i would not have submitted second application. now u r being two A# which are not legal. u should withdraw first application and wait for FP from second application.

I am sure u must have applied by urself. right???
 
Probably BCIS person provided the easiest way to come out from hassle - just cancel the first application and keep the 2nd one. But I feel still there is a way to cancel your 2nd application (as your attorney suggested) and retain the first. See notice dates(ND) on your application receipts (not "receipt date"). If 2nd date is not far from 1st (like 2 or 3 weeks difference), you can cancel 1st application. But difference is too much (like 2-3 months) then I would give a last try to keep my first application. The reason I am saying because in this current unpredictable AOS waiting time and bad economy, advantage of 2-3 months can make lots of difference. So contact BCIS and ask them to cancel your 2nd application (insist on it). If that does not work, just cancel your 1st application.

I agree with "Pralay". If it is going to be 2-3 months gain then it will make a lot of difference.

What you could do is, just pull out the entire set of the second application (i.e. yours and wife's) and apply for your wife with your first application receipt. Would it make sence to you ? It is just a thought and you are the best judge.
