confused on status of I-140. I-485 filed.

I-140 - : RD - Oct. 9 2002 : AD - Feb 7 2003
I-485 - : RD - Jan 10 2003 : ND - Jan 13 '03


My I-140 was filed in Oct. 2002 and I-485 filed on Jan 10 2003, i.e. while my I-140 was still pending.
On Feb 7 2003, my attorney sent out an e-mail saying that I-140 is approved, but he refused to give me the approval notice saying its employer's property. I checked the status on internet and on phone, it says that your I-140 petition was received on October 9 2002. But its still pending.

I am now confused as whom to believe ?? Can any body help.

Hmmm

Fastest/absolute way would be to You can ask the lawyer to fax you a copy of the approval notice - if he is not willing to give you original (though it doesnt make sense) - and later on you can check with your employer to get the original...

second fastest way would be to call an IIO...

I dont think however your lawyer would simply lie to you...only cos it doesnt make sense anyways...What does he gain to lie to you?

Web to AVM or approvals can be at variance at times & out of synch...
 
It looks like the online status is not updated very frequently.

My AP got approved last week and I received the approval notice However, the online status for AP also gives the same ..."your case was received ...we mailed you receipt ..."

So I also hope for the best that, I140 is also approved and its just that the online status not updated on my case.. from past 2 months ..

i believe your lawyer is right. i-140 is the property of the employer. hence you cannot have the original. even if you were to call up an information officer, he would refuse to give you the status of your i-140.

however, you can (and should) ask the lawyer for a copy of the approval notice. [you might need it just in case, in future, you want to use AC21].

Your lawyer is probably correct. My lawyer did not give me my approved I140 either, said it was the property of the company.

With regards to the online case status not reflecting the same, my AP was approved 5 months ago, I still have to see the status being updated from pending.

I suggest, if you have the WAC number call the AVM. Usually it is more upto date.

Definitely ask the lawyer for a copy of the I140, you never know when you might need it.
