pls help! i petitioned my mom and my income was not enough for the 1-864.my husband lost his job. my best friend will co sponsor me for my mom. i know i will still file for 1 864. since i didnt met the requirements, does my co sponsor will add my family size to her household size to qualife for the 125 povertyline line? or just her own household size? any information will be appreciated!

Her household size for the I-864 will be her own household (herself, her spouse, dependents, anybody else she's sponsored) plus one (your mom). Because she is not your household member, she must meet the income requirement without any of your income included, although you must also file an I-864 and list your income.

Thank you for your response, my husband and i filed joint on the income tax should i file 1 864A also and put zero on his income or this is not necessary. Just I 864 for me and my friend, she is divorce and no children. I know she sponsored her relatives before but they are USC now, they will not be included in the household size because they became USC right?

No need to include your husband in this if his income is not going to be used to put you over the threshold (other than for the obligatory aspect of counting your household size and providing tax returns if you filed jointly). Just file one I-864 signed and filled out by you, another I-864 signed and filled out by your friend.

Correct, those relatives who have become USC are not to be counted unless they are dependents on her tax return (e.g. if she has dependent parents).

Hi Jack, just want to confirm since I am not using my husband's income does he needs to fill out I 864A just to provide tax returns that we filed joint?
