confused about the concept of visa numbers

Hi all,

I am new to this forum and I would like your opinion with regards to the issue of non-availability of visa numbers.

Is the visa number problem going to affect individuals who have already filed for the I-140/485 and have obtained their EAD?

This is my situation
RIR/EB2
PD sept 2003 (nebraska)
labor approved in dec2003
140/485 filed in march 04
EAD august 04; renewed in aug 05
140 approved may 2005
RFE july 3 requested and received on july 20th.

will I be affected by visa number backlog which is predicted to hit EB2 in sept 05. I am an Indian citizen.

Currently EB2 is current, which means if your ND is close to published processing date for NSC, you may be close to approval. However, EB2 is romoured to retrogress soon. If the date published PD in monthly visa bulletin for your category is earlier than your PD, you are still elegible for approval. Othewise you will have to wait till the pubished date is past your PD.

YES -- if the new PD is earlier than Sep 2003, you will be affected - otherwise you'll be ok.
