Confirmed! New procedure at NVC

I just spoke to National Visa Center, and they have changed the process of sending out the Packet-3. The operator was very friendly and explained it to me in some detail. Here is what she said:

Old process:

1. NVC sends Packet-3 and Fee Receipt to Attorney
2. Cashier's Check and completed Packet-3 are mailed back to St. Louis.
3. St. Louis cashes the check and forwards the completed Packet-3 to NVC
4. NVC reviews Packet-3 and sends to Consulate.

New process (effective October 1, 2002):

1. NVC sends Fee Receipt to Attorney.
2. Attorney sends Cashier's Check to St. Louis
3. St. Louis cashes check and notifies NVC.
4. NVC mails out Packet-3 to Attorney.
5. Attorney fills out Packet-3 and sends it back to NVC (not to St. Louis any more)
6. NVC reviews Packet-3 and sends to Consulate


The addition of further steps in the process is sure to send the popularity of CP plummeting. More and more people are already choosing Adjustment of Status because of AC21 and concurrent filing. Now with this new procedure, fewer people are going to think CP is worth the trouble.

CP only for people in last stage already

CP at this point makes sense only if you are in the last stages and are ready to file your Packet 3 , else if you are waiting for I-140 Approval etc. Definitely its a no brainer. You can file you 485 and get EADs which saves a lot of trouble even in worst case scenarios. But CP gives no protection whatsoever, now its not even fast.

Like in my case I already filed for I-140 as CP way back in Feb 2002 and it took me more than 6 months from I-140 approval to the Interview date ( which is Nov). But if I could consider concurrent filing add three months to the difference. So a person who chooses 485 would have filed 9 months before I get my Interview date. So the advantage in the speed is of 3 months only assuming AOS takes 12 months. Again you have no other benefit if you go for CP, no EADs no protection against layoffs and cant use the 180day rule. So if you do the math it savs you 3-4 months in terms of speed in the best case.
It will only benifit people who have already chosen the CP and are in the last leg. Else fresh candidates should take the 485 path without doubt.
The above argumnet applies to the Emloyment based categories. Other categories might not have a choice anyway.

Yes kd6809, CP path now looks more dicy with longer processing times and without any protection like EAD 180 day rule etc.,,

Any idea like from when does this new procedure take effect? For me , NVC has sent the packet-3 and asked me to send it to st.louis and I did the same in 1st week of oct.

I spoke to a representative from NVC and they said that this new rule is supposed to be effective from Oct 1. And the old rule applies to all the cases before Oct 1.

Maybe you received your packet in first week of Oct. But even then you would be considered for old rule because they actually must have mailed your packet prior to Oct. 1.

Suggestion: Dont try to outsmart them. Do as they mentioned in your Letter sent alongwith pkt 3.

And if you still not sure what to do then, Confirm by calling them.

Let me add a bit more confusion to this issuse. I've also asked the question on this forum but haven't got any replies.

In my case after the approval of I-140, NVC directly sent P3 to my lawyer and after completing P3 my lawyer DIRECTLY sent P3 to the Consulate.

I am assuming that my lawyer is right and knows what he is doing from the looks of it the procedure might have changed again!! So that now you don't have to send P3 back to St. Louis etc.

Again I might be wrong. All I know is in my case it's not "what I've heard... read told etc." My P3 was difinetly sent directly to the consulate and the consulate has received it.

So it looks like CP is still way faster....

what is the signifence of St. Loius

Hi Aish,

Now where does St. Loius comes into picture, you can pay full amount of fees at the consulate also. Does NVC varifies the fees are paid on US?
 
New Process

I don't think your lawyer should be sending Packet-3 directly to the consulate. I may be mistaken about this, but it has to go through NVC, certainly after Oct 1.

Abhitesh, in response to your question, I guess NVC wants to collect the fee here before even sending a Packet-3, so there's no question of paying it at the Consulate.

I don't know what the number is for St. Louis, or even if they have one that can be accessed by the public. If anybody knows this number, please publish it here.
