Conditions for applying in EB2

I joined a compnay in Oct 2000. Prior to joining this company I had 4yrs and 3 months of exp. with BS(Computer Sc).
My EB2 labor has been approved but lawer is saying that there may be some problem later because I don't have 5 yrs of ex. with BS before joining the compnay.

But my question is whether INS wants BS+5 yrs of exp before joining the compmay or before filing the labor?

There is no category for labor like EB2/EB3 but labor decide about your future means if you see, column on 14 in ETA750 and if you attorney mention BS +5 i,e is job requirement then you are eligible for EB2 and if it is BS 0-4 then you will come in EB3 category.

Before joining the present company, you should have 5 years experience after finishing the BS. The present company experience will not be considered.
Better to file in EB3.
Also make sure in the Labor they did not ask for 5 years experience.

I also heard that but the USCIS website says that it should be BS + 5 years of progressive experience from curent and former employers.

So still I am confused about the conditions.
 
BEFORE joining the current COMPAMY. Period.
The expereince in currrent company does NOT count.
If you still want to try, go ahead and who knows what's going to happen?

I have a similar case as yours. I am 20 days short of 5 years if i count from 'post baccalaureate' to the time i joined the current employer. My Labor Application stated BS + 5 to 10 years of experience.

So i am now worried what category i should file now. EB2 or EB3? Since you are in similar situation would you give me your comments please.

Anybody who can provide me some advice, your somments are most welcome.

Thats a good scneario that you mentioned....if the labor requirement is BS + 5 years exp, can experience earned before earing the BS counted towards this experience???

I would say (again this is my personal comment only)....that it should because take an example of one indiivdual who is already working in the IT area and then earns his BS (say after 2 years of experience in the field) and later has 4 years of experience after getting his BS....will he satisfy the requirements for a LC which requires BS + 5 years experience (note that the LC doesn't explicitly mention that this experience should be 'post baccalaureate' ...

Any other comments/thoughts??
