I have a conditional Green Card that I got throught marriage with a U.S. Citizen. Unfortunately, the marriage ended before the condition on my Green Card was removed. Now, I have been appealing to remove the condition on my Green Card for 5 years. Once the condition is remove will I be able to apply for Citizenship or do I have to wait 5 more years.

why would she have to wait for another 5 years? 5 years are counted from the date Permanent resident status is granted, whether it is conditional or not.

LucyMO is correct.
He has been a LPR for 5 years already. Now the question is how you can appeal for remove of condition without your spouse? They will continue grant you the LPR?

Good luck,

I have similar situation. The USCIS received my appl of 751 in 1st Mar-05 since then no response. But my USC spouse is proceeding divorce from me. Obviously it's very frustrating and stressing for me. I am trying to keep the costive divorce proceeding go as slow as possible, but it won't last after the end of this year according the court schedule. I am trying also to collect as many as possible the evidence of our marriage live together, but my spouse is trying to destroy or hide them. Since we only actually lived together only about 6 months and the rest of our 3.5 year marriage we lived in different states because I was pursuing my PhD. We exchanged numerous visits.

Please post your comments, ideas, experiences & stratigies on what could be my best approach to take to remove the condition. Since most of marriage we lived separately, it's a drawback plus my spouse's uncooperative/destructive actions.

Thanks,

A desperate person

P.S. mine is in Nebraska Center

What's up Soulship? Hope you are doing okay. I'm sorry to hear about what you are going thru with your wife. My advice to you is to get a good immigration lawyer because if your wife is destroying evidence of your marriage. That is not going to help you. Most likely you are going to have to appeal if immigration decides to take your Green Card from you. That's what happen to me and I have been in the appeal process since 2001. I wish you the best of luck.

P.S. Try to work something out with your wife. Tell her not to destroy evidence of your marriage and to remember the reason why she married you. I'm not sure if that is going to work, but you should try.
