Hi,

I have question about filing I 751
If someone is already married for 2 years and just got conditional GC, can that person apply for 10 year GC ( removal of condition : Form I 751 ) earlier than waiting for 2 years after getting conditional GC ?

I am asking this question because the whole idea of issuing conditional GC is that USCIS want to see if marriage is bonafide and they stay stand each other for atleast 2 years. If couple is already living together for 2 years, who wait another 2 years for removal of condition.
 
if the couple has been married for 2 years or more, on the date that the GC is approved, then the alien SHOULD receive a 10 year unconditional Green Card. If this does not happen, in most cases is an error. You can correct it by filing an I-90 with USCIS and receive a corrected GC.

Is this your case? it may be best to make an infopass first, to double check it is indeed an error and not the decision of the IO (which can happen).

Was the actual date that the Conditional GC was approved prior to the 2 year wedding anniversary or after? Not the date it was received, but the date it was approved.

GC is approved 3 weeks prior to 2nd anniversery. But GC is not received yet
 
it doesn't matter when it is received. since it was approved prior to the 2nd year marriage anniversary you will get a conditional GC.

And you will still have to wait until 90 days prior to it expiring to apply to have the conditions removed - regarless of how long you've been married.
