concurrent I-140 and I-485

What will happen if I-140 and I-485 (and EAD) was applied concurrently, and
if I-140 was rejected for some reason, and
the person had started using his EAD.

I-485 will most likely get denied and so EAD also could become invalid.

What if at that time, person files the case to AAU for I-140? Would I-485 and EAD would be considered valid, and would the person be considered in legal status?
 
from the date your I140 was rejected, both AP and EAD became invalid. Unless you have other legal status, you are supposed to leave the US. unfortunately ... what a *great* US.
 
What happens to EAD status if we file a Motion to Reopen (MTR) to reconsider I-140 decision? Will this not make EAD a valid one?

Hi Pharma,

I checked out this question with other lawyer site, and found that if I-140 is filed to AAO/AAU by Motion to Reopen (MTR) the EAD/ AP remains valid as long the case against I-140 is finally denied (?)

The above statement is confirmed INS General Consel. So need to worry much :)
