If one has filed for H1 from company A - visa is yet to be approved. Can he file another H1 petition from company B?

Will he have to file as new H1 case or as an H1 transfer case? (Since both jobs are 9 to 5)

The person in on OPT and is eligible for masters quota. He has not yet started working for any of the company.

All these provisons are only available to H1b holder (having valid i-94 with caveat H1). You so for do not have any h1 in your hand, all of your appliation will be considered new and come under annual quote. If you have Masters from US (graduated and diploma in hand) you are eligible for 20000 visa quota. It will get exhausted with in a week.
