concurrent h-1 b please help...

I am on an h-1 b currently for a nonprofit instituition for the last 2 years , can i apply for a concurrent h-1 b for a profit instituition, will i be under the cap , according to the press release by USCIS on june 1 2006 , they mentioned concurrent h-1 b are exempt , but i want to be sure by someone who knows about it.Please reply, it will mean a lot to me.

You need brandnew cap-subject H1 if your current H1 is cap exempt.
Recent memo only says you are cap exempt if you are hired by profit employer but working at non-profit employer.
