Concurrent Filing & I140 Approval & Invoking AC21

Hi Folks,

following is my date summary

1) 4th April 07 , Applied for I 140
2) July - 07 Fiasco.
3) Applied Concurrently for I485 for future employee
4) 24th Aug 07 :: I 140 Approved :: 240 Days
5) 16th Oct 07 :: I485 Receipt date :: 187 Days

Now if i apply for EAD and leave the employer using AC-21. so i have to wait for another 180 after i get my EAD or I485's 180 days is sufficient.

your I-140 is approved and your I-485 is pending more than 180 days and that makes you eligible for AC21, you can join new employer with Valid EAD in hand or with H1 transfer. dont talk to present company lawyer for change of employer or AC21

so there is no need of working on EAD with current employer...and later use EAD for new employer.

Once my Green Card is approved do i need to join back my employer ( who has filed my I485)???

------------------NO, you should work with new employer who will give you permanent job offer letter. you need to work for 6 months with new employer after getting GC

if you use EAD with current employer you will not be on H1 status, if you use EAD with new employer then also you will not be on H1 status. it is better to remain on H1 status. join new employer with H1 transfer and if new employer does not file H1 transfer then you can use EAD.
