Hello RaviPri,

I am not so sure about this one. I am assuming you are on H4 currently, right?
Has your husband applied for your I-485? If NOT, I think your husband can still apply for you as the secondary applicant as long as his I-485 is not approved (DONT KNOW HOW RETROGRESSION WOULD AFFECT THIS?)
Just make sure from your husband's company lawyer.
I have absolutely no idea how USCIS works and when they will approve or work on I-485. I wish I knew :rolleyes:
Anywayz, I am not a lawyer or a legal consultant, so its better to ask someone who might be legally competant.

Yes, I am in H4. My husband applied for I-140/EAD/I-485 together on May 6 2005 and he got the approvals for I-140/EAD and also got the finger prints.

am I eb3?

Hi,

I am on H1B I have a BS degree; does this make me EB3? how can I know for sure? is there anything in my labor certification application that can tell that?

Also I am waiting for the LC (DBEC) I have noticed the visa numbers for EB3 are unavailable for sept2005, when do you think are the visas going to be available again ..this is for filling I485.

I live and work in Menlo Park California, H1B on 6th year my wife is on H4.
I am Peruvian.

:mad: Just reviewed the October visa bulletin... we're basically all screwed.

For me, there is a 5 year gap between the visa date and my priority date.
 
Just a quick thought/question.
Till June 2005 - The Priority date was 1 June 2002 and USCIS excepted the 485 applications. That means whoever filled GC applications before 1st July 2005 have been alloted Visa Number.

Now if Priority date has been retrogressed to Janurary 1998, how those applications be effected? I think USCIS will still process those applications.

I guess you are OK JT_PERM. You might get your GC in another 6/7 months or so.

I have seen 2 LUD's so far on our I-485's.
LUD1 on Sept 9, 2005: FP results recd. processing on case resumed.
LUD2 on Sept 12, 2005: Same msg. as LUD1.

Donno what this means?
But with retrogression everything seems so hopeless! Still keeping my fingers crossed.
