Concurrent Filing - CSC -March2005 to May 2005 - pls post your dates

Question regarding coucnrrent filing in Apr 05
Hi All,
I am a new member here, although I have been a silent reader for some time.
My H1 6 years get over in mid-july 05(another 3 and a half months).
Company filed for concurrent 140/485/EAD/AP based on a pre-approved labor(EB3 - PD is Jan 2002) at CSC on Apr 1st 05, but somehow USCIS rejected concurrent filing saying there are no visa dates available. Company Lawyer has replied and it seems concurrent filing will be accepted.
My question is, since I already have less time on visa, will the original date of 140/485 filing(Apr 1st 05) be considered towards 90 days for EAD or will they consider the date lawyer replied as the application receive date? Also, are 90 days for EAD appproval counted from Receive Date or Notice Date?

When you say your concurrent filing was rejected, atleast the I-140 was accepted or not ? After how many days of filing did you get to know this and how?
And what do you mean by the fact that ur lawyers have replied? Did they send you a questionnaire or asked for any specific details? If visa numbers are up (ie they are using the filing date as PD), what is your lawyers reasoning in saying that it will be accepted.
Pls let us know what the exact situation is.
The EAD takes upto 90 days (u can get an interim if 90 days r up). u may get the ead much earlier than that.

I think its just that the PD of the pre-approved labor was not properly noted by USCIS and thats why they rejected concurrent filing. But as per the lawyer(I am not sure how he replied) once the mistake was pointed out, they accepted the applications on Apr 11 and I received the receipt numbers 2 days ago from the lawyer. I just wasted another 7-8 days. Thanks for your reply..
