Complicated Question

Hello everyone, hope you're enjoying your summer.

I'll try to briefly explain the situation and ask the questions at the end.

I married my wife 4 years ago (she's a US citizen), she was already pregnant by someone else when we got married (First red flag), a couple of weeks after we got married, we tried to do a petition for me so I could start working and she could stay at home, it was denied right away because I didn't have everything I needed (state ID...how was I supposed to legally get it?? eh, whatever).

We lived with her mom throughout her pregnancy, stayed there a few more months. It was very frustrating, I didn't feel comfortable to illegally get a job (I know many do it, but I get paranoid!). We couldn't afford to keep the child, so we decided to let her mother adopt the child, which she did.

After a while, we decided to go our separate ways, after a few months we decided to give it a try again (at this point it's been 2 years since we got married). She's a very troubled woman, she's been arrested for drugs and crazy things like that (another red flag), we tried for a while and again, we decided to part.

So after a while, WE TRIED YET AGAIN! We're living together (third year), she confesses to me she's pregnant again, to discover that again, it's not my child.... you can imagine how I felt. This time we promised we wouldn't give her child to her mother, we decided to keep her. We're having trouble again and we're thinking of ending this already.

Now my question is. After being married for 4 years, her having that criminal record I mentioned, her having 2 children that aren't mine, separated many times. What would be the outcome of a petition?? Will it backfire on me? She feels really bad for some of the things she's done, and she says she would remain married to me during the petition.

first of all, you didn't get a denial for not having a state ID. You are confused or you are lying. You don't need to have an American State ID to successfully do AOS. You have to have another govt issued id - like your passport.

You also have to have proof that you have entered legally - with a visa or a visa waiver. Do you have proof?

Second, did you or did you not apply for AOS for the second time?

Third, the marriage didn't work out for you three times already. You wife has managed to bear two children by someone else. I think it's a good sign that you need to move on. If it is not your child, don't put your name on the birth certificate. You will owe child support for 18 years. You have legal rights.

I'm not lying nor am I confused. We did go to the immigration office, as soon as we handed the woman an envelope with all the documentation, she said "where's your state ID?", I told her I did not have one and she started saying things like "Oh, so you're here illegally? you NEED a state ID, come back when you have one". So, I may be confused as to the process for this, but definitely not lying.

Yes, I do have proof of entering here legally.

We did not try for a petition again, what I meant by "trying again", was trying to be together again.

First I think you are lying. One, you do not HAND OUT petitions... you mail them. Two, you say you have not been working illegally but you have been in this country for 4+ years (overstay I assume) and not worked? so you live on what? no food?

Lastly, we are not going to tell you what you need to do, in order to circumvent (cheat) the US Immigration laws, so you can get a Green Card based on a fake marriage. Just file for a divorce and go back to your country. :mad:

in 2001 it was possible to do a walk-in to submit your docs. However, you weren't formally denied AOS, since you stumbled into a clerk (most likely, not even an immigration officer) who didn't know much about immigration petititons. It wasn't a denial.
