Complicated DV Situation - Need Urgent Advice!

I am having a serious conundrum. I am looking for some advice and hoping that someone with the same/similar experience can share their thoughts. Here is my situation:

I won DV2007 and recently applied for AOS when my number became available. Currently, I so have an interview scheduled at the end of August. Here is the sequence of events:

July 1st, 2007 – Applied for AOS
July 15th, 2007 – Receipt notice
Aug 1st, 2007 – Fingerprints taken
Aug 24th, 2007 – Interview is scheduled for this date

While the interview is scheduled from what I understand there is no guarantee that the name check has been completed? The clock is ticking and I only have one month left before the end of the fiscal year from the time of the interview.

At the same time I’ve had a pending case for immigration through employment. As I just discovered because of the USCIS mix up I can file for ANOTHER AOS (I-485) through my employer before August 16th, 2007 (I am currently on a work visa). If I don’t file now, I will probably have to wait for another year and pay twice as much money in new filing fees.

This leads to a question:

At this point, in your experience, how good of a chance do I have getting the green card if the interview has been scheduled for this date (given the interview goes well). Does this mean the name check went through? Should I even consider filing another case through employment (as an insurance policy in case anything goes wrong with my DV case)? I am concerned that filing another case could complicate the matter (if they discover I have two pending cases at the interview) plus it is also another big expense.

What would you do in this situation? Take the chances with DV or file a “backup” case?

Hi Ky4ep,
NC could be done before interview - make InfoPass for some Aug 20-22 fo ask USCIS officer about it. To be on save side please find out who are yours US Senator and US Congress Rep. Call to their Constitutional Services and ask about the advice for your situation.

Hi ky4ep,

Me and my wife had similar situation as you except we are DV2008 winner with kind of low number and we are doing CP. You can read my previous post at http://www.immigrationportal.com/showthread.php?t=258829

As many knowledgeable members on this forum suggested, it will be wise to do both especially in your case if you can. I will suggest you contact an immigration lawyer for advices on whether you can do two AOS at the same time.
