Complex question :Hoping simple answer

Call me a paranoid but I guess I have to be as Iam planning to buy a house in california !

MY RD is sept 2002 and RFE recieved in may and no approval yet . Meanwhile I have my 8th year extension H1 valid till december 2004 . I have not switched to EAD as my company prefers me on visa and they keep extending it for 1 year every year till I get my gren card.

Now my question is in case of a rejecttion of 485 (I pray everyday that this doesnt happen to me) will I be illegal immediately or until I have my valid H1 ?
Remember this H1 extension was filed because of my pending 485 approval

Second question is if I had EAD instead of H1 then am I illegal imdtly ?

As long as your I-485 is pending, you would be elligible to apply for H1 ext (8th yr). If your 485 is denied (hope should get approved), you cannot apply for 8th yr H1, but can legally stay upto the expiry date on current H1.
Any way if you move to EAD, you will become illegal as soon as your 485 gets denied...
 
what can be paranoid in buying house in california? don't understand. I bought a house in california even before submitting I-140 application.

Since 2002 to now..., the housing prices in CA have almost..., I said almost..., close to double the price..., so at least you made some money...

I also bought a house in CA in 2001 (before applying for I-140).
I then bought another house in FL couple of months before getting my GC approval. Nothing wrong with it ... I'll keep buying ... :D
 
Keep buying and good luck from me to you .However there is one mix I forgot to add . If I can neither appeal for EAD nor apply for H1 can I be on H4 if my wife has H1 in this case?
