Completing six years of H1 Visa, Please advice

I am a software professional who is currently on H1B status. The six year period of my H1B visa expires in JUly of 2006 and my employer has not yet filed for my labor. Can you please let me know what are my options for
extending my stay in US.

1. Can I file for extension of my H1B without a valid labour application ?
2. Can I convert my H1B visa to F1 and apply for a new H1B after a year period ?
3. Is it compulsory that I leave the country for a year and then apply for a new H1B ?


Any help in this regards is greatly appreciated. Please advice

1. No. You need LC no matter what basis your H1 extension is on(LC or approved I140).
2. you can change to F1, but you can not get H1 after a year of F1 status.
3. It certainly works.
