Here is my complete experience about getting AP from Local INS (San Jose).

Hi All,
I applied for AOS (485/EAD/AP) on Jan 11th, 2002 (RD). I got the receipts from INS CSC for my family (wife and son) and self.
On March 4th, when I heard AVM for my AP approvals, found that my wife’s AP was approved on March 1st and was mailed. Then checked mine and my son’s, AVM played the same message that it was received on …
On March 9th (Saturday), in the mail I received my son’s and my AP approval notices with approved date of Feb 28th, 2002. I was hoping that my wife’s AP would also follow.
On March 11th, we spoke to IIO and the confirmed that it was mailed on March 1st and my address was correct. So, we waited but during that time we had a family emergency in India and my wife needs to visit her mother. As the saying goes, when it rains it pours. Our ‘fun’ with INS started from that day. During that week, I called up my lawyer (based in New York) and informed him about the emergency and non-receipt of the AP for wife. He was not much help (Who thought so..!!). But he called me next day and informed me that they received RFE for my wife’s AP with RFE date as March 1st, 2002. He sent me RFE as fax and it requested additional evidence, like marriage certificate. As per my lawyer, when they filed my wife’s AP, they did furnish all this information. Then after repeated and frustrated dialing for the IIO, we got hold of one lady and asked about my wife’s AP. She re-confirmed that it was approved on March 1st and mailed also. She said that there was no RFE and may be delayed due to mailing problems.
Somebody informed us that if we have emergency, we could walk into a Local INS Office and get the AP. So, we decided to try that. We got the required doctor’s letter (faxed) from India. On March 13th, we went to San Jose INS. The receptionist informed us that it’s not possible to get AP for employment based case and should send a fax enquiry to INS CSC center. He refused to here our case and kept saying that they wont issue an AP. So, we came back and decided to go to INS District Office at San Francisco. On March 15th, we went to San Francisco, since we went around 8am, we couldn’t get the token number. At the reception counter, she asked like why we came here and what is the emergency. She told us to come on Monday. So, on Monday 18th, we went around 5AM and stood in the line (she was 8th person). She was give the token number and when her turn came, she submitted the documents. Officer looked at the papers and went in to talk to a Supervisor. She came out and informed my wife that since I belong to San Jose, I should get it there and they cannot help. But we informed that San Jose refused to give. Then she suggested sending a FAX enquiry or a prepaid fedex to CSC Laguna. We were REALLY frustrated. We came out and rushed to San Jose. We stood in the line by 10:30am, but by that time tokens were over. So, we decided to come next day.
On March 19th, we went around 5.30 am. There were like 500 people before us. We stood in the line and around 10 am, we went inside. After initial struggle with the receptionist, my wife got the token number. Luckily, when turn came she went to a window, where a Desi Guy manned it. He could understand her frustration and suggested her to meet Supervisor (upstairs). So, she went up and met this lady. She was very kind. Using my wife’s A# she could pull up her AP details. She noted that my wife’s AP was approved and mailed on Mar 1st. So she can either wait for that to come in mail or apply for a new AP. My wife chooses the later. So, the Supervisor took all my wife’s documents and issued a note. This note asked my wife to come back around 1pm to collect the AP. That’s IT. We went around 1pm and got the AP.
Thank GOD!!

Points to note:
1. My SIX year H1 expires on April 1st, 2002. My company not willing to apply for 7th year extension.

At San Francisco, we were never given the chance/choice.
At San Jose, the Supervisor gave this option.
