Hi All,

I have hopefully a very simple question. Please respond to this.

Does the financial position of the employer matter at 485 stage?I think I saw couple of posts asking for company's ability to pay the salary and hence its financials were asked. Is this a random case or a possible query?

Is it a problem if I join a small consulting company using AC21 after 6 months have elapsed from 485 filing date?

I know the salary may differ(+ or - from LC salary) and lot of people have got approved with this, but am curious and keen to know if joining a small (say 1 -10 employees) company would create problems for 485 approval.

Does the financial position of the employer matter during the 485 approval ?

Please respond. Thanks in advance.

I will cite one example of a friend whose I-140 at TSC was declined(2.5 yrs ago) based on company's yearly profit. His salary was quoted as 65K and company's tax return showed a profit of 85K, INS rejected his app saying that Company does'nt have enough funds to pay employee. His company had only 4 employees. He then joined another company and restarted his GC process from scratch.

companies like CISCO show big $$$ lost in their books, do you think INS will reject anybody work there?

ThakurSahab,

I understand companies financial position being considered during the 140 stage. The situation I am referring to is after the 140 approval.

After the 140 approval and after 6 months of filing of 485 does the companies financial position considered at all? Does the size and financial status matter at this stage.

I believe it should matter, since GC is for a future position, and the company should be able to pay you in future. for which they have to be financially ok..
