Hi guys!
I asked this question on the I-140 forum but didn't get any answer. I wonder if any of you has any idea.

Here is the issue: my hubby's I-140 is still pending after submitting RFE on June10th (received on June 12th). The irony is that the company was bought out exactly on June 10th, so the docs submitted were still with the old company.
Now... should the new company submit that amendment as soon as possible or just wait for BCIS to make a decision in this case?

Amendment is required anly if I-485 is adjudicated with in 180 days, it doesn't happen any more. So I-140 amendment is not required since you can always use AC21 after 180 days of pending I-485 eventhough this is company merger.
 
Thanks. But I still don't get it. The merger happened before 180 days in both 140 and 485. what sould be my pro-argument in this case?
 
Hi badobo and the others.

My hubby's 140 EB-2 was finally approved yesterday. (as per website). His EAD was also approved, but mine not. Since I already have the iEAD, are they going to approve the original?

It's such a great relief.

RFE: company's ability to pay. I am not sure what they submitted, but If you look on my previous posts you'll see we had a lot of problems: the company didn't have either 2002 taxes or the audit raport (as BCIS had asked). If I'm not mistaken, they submitted some 2002 tax drafts.

Congratulations on I-140 approval.

What do you mean by iEad? I never heard that before. I know that we can file Ead electronically. Did you get the approval or Ead electronically?
 
i-EAD is interim EAD.
If u dont get an EAD within 90 days of filing for EAD, u can go to ur local BCIS office and get an i-EAD.

I think u will receive the original EAD also - i have just applied for my first EAD and waiting - so not sure about that.

asifdhanani: it was CSC. Good luck to you. Try to stay away from checking the BCIS website three times a day. It drove me crazy.
